Duties Of An Advocate

An advocate should be well equipped with the knowledge of law and the art of advocacy. He should exercise special care and skill in performance of his duty.
A person who is engaged in practicing profession of law is called an advocate. Person cannot claim to be an advocate merely for the reason that his name has enrolled in Bar Council.



i- Duties of an advocate in following heads

iii- Duties to other advocates
iv- Duties to Court
v- Duties to State
vi- Duties to General public

Following are the duties of an advocate to self.
i- He must be character full
ii- He must be Loyal
iii- He must be Honest
iv- He must be Careful
v- He must be Sympathetic
vi- He must be True to his words
vii- He must have Professional skill
viii- He must be a moral man
ix- He must be Independent of ideas



Following are the duties of advocate towards the other advocates.
i- Duties not to conceal his Clint
ii- Duties not to interrupt
iii- Duties not to laugh at opposing council
iv- Duties to encourage new lawyers
v- Duties not to Take mean advantage
vi- Duty not to defame adverse council
vii- Duty of patience in hearing

Following are the duties of an advocate to his Clint.
i- Duty to give better opinion
ii-Duty not to advise violation of any right
iii- Duty to receive reasonable fee
iv- Duty not to finance litigation
v- Duty not to compromise without consent of parties
vi- Duty to focus on compromise between parties
vii- Duty of patience while hearing

iv- Duty not to coach witnesses
v- Duty to maintain dignity of court
