Identification Prade

The court has every often to determine the identity of person and things to conduct the identification parade is a part of investigation and it is not a rule of law.Identification parade derived from two words identification which means to prove or parade means procedure on which it is done.Identification means to prove that a person subject or article is that which is alleged. Following are the objects of the identification parade.

a- To check against false implication

b- To authenticate the identify of real culprits

c- To satisfy the investigation authority

d- To furnish evidence for corroboration

Identification parade is needed when accused are not known previous witness. Identification parade should be conducted as early as possible after the accuse arrested. Identification parade after 12 to 15 days loses its evidential value. Identification parade held by magistrate having jurisdiction to do so.

Following are the principles relating to conduct of identification parade.

a- As early as possible

b- Description to accuse by witness

c- Presence of dummies

d- Description of rule of accused in identification parade

e- Precaution measured by police

Identification parade should be conducted as early as possible

Identification parade held after 10 days is not considered is proper manner. Identification parade test held only after the witness has giving clear description of accused. At least 10 under trials should be intermingled with one accuse criminal in the identification parade to eliminate possibilities of chance in the identification parade. 

While picking up accuse the witness has described the role played by that criminal in commission of offence. Otherwise rendered proceedings shall be illegal or un-reliable of no evidential value. Precautionary measures to be taken by police before identification parade must be strictly observed. After conducting identification parade magistrate has to prepare a report and mention every detail in it.

 Identification parade is held to judge for the memory of witness that was he able to remember any partial feature of person whom he had seen at the place of occurrence. Identification parade test is evidence on which convention can be based. Identification parade is only a corroborating piece of evidence.

Identification parade is not a piece of evidence it can only be proved as helping evidence.
